FIELD TRIP GRANT PROGRAM
OFFICIAL RULES

To participate in this Program, you in your capacity as Application Contact for your school (as defined below) must agree to and abide by these Official Rules.

Eligibility: Program open only to Kindergarten (5K) - 12th grade public schools or non-profit private schools with Internal Revenue Service 501(c)(3) status, in the following counties in Wisconsin: Dodge, Jefferson, Kenosha, Milwaukee, Ozaukee, Racine, Sheboygan, Walworth, Washington and Waukesha counties (each, a “School”). Public schools are as defined by the Wisconsin Department of Public Instruction and include charter schools, 2r charter schools, magnet schools, alternative schools, vocational schools, partnership schools, virtual and special needs schools. For the avoidance of doubt, the Program is not open to persons engaged in other forms of education/instruction, such as 3K, 4K, home-schooling, summer programs and daycares.

  1. Program Entry: Please consult the overview of key dates and times above. Kohl’s “Field Trip Grant Program” (the “Program”) begins on or after 12:00:01 am CST on 2/13/17 and ends at 11:59:59 pm CDT on 3/17/17 (“Program Period”). Administrator’s computer is the official clock for this Program.

    1. SCHOOL REGISTRATION: During the School Registration Period (as defined above) navigate the internet to www.Kohls.com/fieldtrip (“Website”) and take the following steps to complete the registration process:

      1. Click the “Register” button. Type in your personal school email address and password that you can use to login each time you access the Website.
      2. Application Contact Information: Type in your first name, last name, position at School, email address (at School) and direct phone number at School. (For the avoidance of doubt, you are submitting an application for a grant to be used by your School, NOT by you personally.) NOTE: only persons who are principals, assistant principals or other school administrative personnel with supervisory responsibility over students and/or matters of School policy may serve as a School’s Application Contact. If you do not meet this criteria, you CANNOT serve as a School’s Application Contact. By way of example only, the following are NOT permitted to serve as Application Contact: teachers, parents of students enrolled at the School, members of the School’s Parent Teacher Association or other like organization, school board members and School support personnel (e.g., lunch aide and janitorial staff). Note: Only one (1) person can serve as the School’s Application Contact and submit application(s) for the Program on behalf of a School.
      3. General School Information: Select the Wisconsin county wherein your School is located and then select your school from the drop down menu. (For the avoidance of doubt, if your county and/or school is not listed, your school may not be eligible for the Program; in such case, you may enter your School’s county, name, city, main phone number and School’s main email address. Sponsor/Administrator in their sole discretion will determine whether your school may be included in the Program.) You may also be asked to confirm that your school is tax-exempt under section 501(c)(3) of the Internal Revenue Code.
      4. Principal Information: Type in the School’s principal’s first and last name, direct phone number (at School) and email address (at School).
      Carefully read the Official Rules and Privacy Policy, then click the check boxes signifying that you have read, fully understand and agree to these Official Rules and that you possess all required right, power and authority to submit an application for your School in the Program and that, to the best of your knowledge and belief, no regulation, rule or School policy would prevent your School from participating in the Program or receiving grant monies from Sponsor (if application is accepted). Sponsor or Administrator may request you to provide proof as to your possession of all right, power and authority to submit application for your School; and, if such proof is deemed inadequate in any regard (as determined by Sponsor or Administrator in their sole discretion) or should you fail to provide any proof within the time period indicated by Sponsor/Administrator, your School shall forfeit any right to any grant monies from Sponsor and Sponsor shall have no liability or obligation to your School. Click the Submit button to send your school’s application.

      IF YOU DO NOT CHECK THE BOXES INDICATING YOUR AGREEMENT TO THE OFFICIAL RULES AND ACKNOWLEDGING THAT YOU HAVE ALL RIGHT, POWER AND AUTHORITY TO SUBMIT AN APPLICATION FOR YOUR SCHOOL IN THE PROGRAM, YOUR SCHOOL’S APPLICATION WILL NOT BE ACCEPTED AND SPONSOR AND ADMINISTRATOR WILL HAVE NO LIABILITY OR OBLIGATION TO YOUR SCHOOL.
    2. SCHOOL CONFIRMATION: Administrator will review all School Registrations during the School Confirmation Period. If approved as an eligible school, Application Contact will be sent a Confirmation email to the email address he/she registered with by Friday, March 17, 2017 (be sure to add KohlsFieldTrip@leaddogmarketing.com to your Safe Sender’s List to ensure receipt of all Program emails). Approved Schools may then proceed to Step 1C.
    3. GRANT APPLICATION: During the Grant Application Period navigate the internet to Website and log in to your account to complete the application process:
      1. Field Trip Location: Enter the name of the teacher requesting the Grant. From the drop down menu, select your School’s desired Field Trip Location and desired Month of Field Trip. The following Field Trip Locations are available: Betty Brinn Children’s Museum; Discovery World; Hunger Task Force, Junior Achievement of Wisconsin; Milwaukee Art Museum; Milwaukee County Zoo; Milwaukee Public Museum. (For the avoidance of doubt, only the listed Field Trip Locations are available in the Program.) BE SURE TO SELECT FIELD TRIP LOCATION CAREFULLY, BECAUSE ONCE CHOSEN IT CAN ONLY BE CHANGED WITH THE EXPRESS WRITTEN CONSENT OF SPONSOR, WHICH MAY BE GRANTED OR WITHHELD IN ITS SOLE DISCRETION.
      2. Select Grade(s): Select the grade(s) of the students at your School that are participating in the field trip. If students from more than one (1) grade are participating, type in the number of students in each grade, as well as the number of teachers/chaperones at your School who will accompany students on Field Trip.
      3. iii. Select grant amount (Expenses/Budget): Enter the eligible expenses for which the grant money will be used. Eligible expenses may include: admission/participation fees, transportation/bus fees, substitute teacher fees, workshop fees, and required materials for the field trip fee. Based on multiple variables admission and workshop fees are subject to change. Sponsor is not liable for any additional expenses incurred as a result of such changes. Eligible expenses must be entered in totality, NOT per student. Grants can NOT exceed $1,000.00.
      Application Contact may apply for up to seven (7) separate grants (maximum of one [1] grant per location). Please apply for grants in the order of importance to your School. For the avoidance of doubt, a School will only be awarded a maximum of four (4) grants. Steps i – iii do not need to be completed in the same Internet Session but you must click the “Save” Button at the bottom of Website before leaving the page in order for previously entered information to be saved. If you click “Save,” previously entered information will appear once you login again with the email address and password submitted in Step 1A. ALL APPLICATION INFORMATION MUST BE ACCURATE AND COMPLETE TO THE BEST OF APPLICATION CONTACT’S KNOWLEDGE AND BELIEF; SHOULD SPONSOR/ADMINISTRATOR CONCLUDE THAT SUCH IS NOT THE CASE, THE APPLICATION WILL BE REJECTED. SUBMISSION OF AN APPLICATION WHICH IS INTENTIONALLY MISTRUTHFUL CONSTITUTES FRAUD, SPONSOR/ADMINISTRATOR MAY TAKE ANY AND ALL ACTIONS ALLOWED BY LAW SO AS TO PROTECT THEIR RIGHTS. Grant application must be submitted in accordance with the procedural user requirements of the Program (as set forth on the Website), which are incorporated herein by reference and made a part of these Official Rules. Partial submissions will NOT be accepted.

      All applications must be received by 11:59:59 pm CDT on 3/17/17.
    4. Grant Application Approval: Administrator will review all Grant Applications received during the Grant Application Period. If a Grant Application is approved, Application Contact will be sent an Grant Application Approval email to the email address he/she registered with by Wednesday, March 29, 2017. Such email will include a Grant Acceptance Form, wherein Application Contact confirms the accuracy and completeness of all information included in application(s).

      Grants will be awarded to Schools on a first-come, first-served basis. School’s applications will be approved in the order of which they are received, so long as funds for a given application’s requested Field Trip Location remain available (up to four [4]). SUBMISSION OF AN APPLICATION IN NO WAY OBLIGATES SPONSOR OR ADMINISTRATOR TO ACCEPT APPLICATION AND AWARD GRANT MONIES TO A SCHOOL, EVEN IF IT IS ELIGIBLE. THE DECISION WHETHER (OR NOT) TO ACCEPT APPLICATION AND AWARD GRANT MONIES IS AT SPONSOR/ADMINSTRATOR’S SOLE AND ABSOLUTE DISCRETION. SPONSOR FURTHER RESERVES THE RIGHT, DUE TO AVAILABLE GRANT MONEY THRESHOLDS FOR FIELD TRIP LOCATIONS OR OTHER REASONS TO AWARD GRANT MONEY TO SCHOOLS ONLY IN PART. If awarded, grant is to be used for Field Trip to indicated location in the following school year (that is, the 2017 – 2018 school year). Grant monies will be distributed to approved Schools in June 2017; School is responsible for payment to the Field Trip location. School is responsible for any cost(s) that may be incurred above and beyond the approved grant amount. Application Contact may be required, at Sponsor’s/Administrator’s sole discretion, to complete, sign and return within an indicated time period an Affidavit of Compliance and/or other materials substantiating that the grant money was indeed used to pay for eligible expenses in conjunction with a Field Trip to the indicated Field Trip Location. Failure to timely comply with these requirements (as applicable) or if requested materials are deemed inadequate in any regard (as determined by Sponsor or Administrator in their sole discretion), School shall refund to Sponsor immediately the full amount of the grant money and Sponsor and Administrator shall have no liability or obligation to School. (But, return of the grant money shall not relieve Application Contact and/or School of potential liability to Sponsor and Administrator.) Grant may be awarded to School if Sponsor and Administrator determine that School is eligible and application is valid as per these Official Rules; the decision whether (or not) to award a grant to a School (and, if awarded, the amount of the grant) is at Sponsor’s/Administrator’s sole and absolute discretion.
    5. Grant Acceptance (Form Return): Grant Acceptance Form must be completed, signed and returned by Friday, April 7, 2017, it being understood that an electronic version of the Grant Acceptance Form shall have the same, legally binding effect as the original hand-signed document. In the event of noncompliance with this requirement and/or if the email notification is returned as undeliverable after three (3) attempts, such School’s application(s) will be rejected and such grant money restored to the pool of available monies for the corresponding Field Trip Location as per Rule 3 below.
    6. Grant Confirmation: Administrator will review all Grant Acceptance Forms during the Grant Confirmation Period. If Grant Acceptance Form is confirmed, Application Contact will be sent a Grant Confirmation email to the email address he/she registered with by Friday, April 21, 2017.
  2. Application Restrictions: Schools can apply for up to seven (7) separate grants (maximum of one [1] grant per location). Application Contact should apply for grants in the order of importance to his/her School as grants are awarded on a first-come, first-served basis. For the avoidance of doubt, even if a School applies for more than four (4) grants, a School will only be awarded a maximum of four (4) grants. Each grant may only be used for a Field Trip to one (1) of the indicated Locations: SCHOOLS CANNOT BREAK UP OR APPORTION GRANT MONEY BETWEEN DIFFERENT FIELD TRIP LOCATIONS. Sponsor and Administrator will not be responsible for late, lost, incomplete, illegible, damaged, garbled or misdirected applications/materials. As between Sponsor and School, all application materials become the property of Sponsor and will not be returned. By submitting an application for the Program, Application Contact on behalf of School agrees to these Official Rules and the decisions of Sponsor and Administrator, which are binding and final in all matters relating to the Program. Receipt of application will be acknowledged; but such acknowledgment in no way obligates Sponsor to award grant monies.

    By submitting an application, Application Contact, on behalf of School, agrees to indemnify, defend, release, discharge and hold harmless Sponsor, Administrator, their respective parent, subsidiary and affiliated companies, advertising and promotional agencies, as well as the Field Trip Locations and their respective officers, directors, employees, agents and representatives (“Released Parties”) from any and all claims, liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to death or personal injury, arising out of a School’s participation in the Program, including but not limited to Sponsor’s award or refusal to award School a grant, or the School’s acceptance or use of grant monies. All federal, state and local laws and regulations apply.

  3. Allocation of Grant Monies Among Field Trip Locations:

    IN NO EVENT WILL SPONSOR’S TOTAL FINANCIAL OBLIGATION FOR A GIVEN FIELD TRIP LOCATION EXCEED THE CORRESPONDING AVAILABLE GRANT MONEY THRESHOLD. Field Trip Locations are subject to availability and other restrictions. Once the available grant money threshold is reached for a given Field Trip Location, such Field Trip Location will no longer be available. Should any available grant monies remain at the end of the Program Period, Sponsor in its sole discretion, may award such monies on a first-come, first-served basis (as determined during the Grant Application Period).
  4. Additional Restrictions: Certain Field Trip Locations (such as, Hunger Task Force, Junior Achievement of Wisconsin and Milwaukee County Zoo/Zoological Society of Milwaukee) may have special curriculum or other requirements for Field Trip. It is School’s sole responsibility to acquaint itself and comply with same. If School fails to comply with such requirements, Sponsor’s/Administrator’s liability will be limited to allowing School to choose from remaining available Field Trip Locations, subject to such Field Trip Locations’ available grant money threshold; and, should no other Field Trip Locations still be available, Sponsor and Administrator shall have no liability to School and School must return grant money to Sponsor immediately upon demand. If, after scheduling a Field Trip, a School has to cancel or postpone the Field Trip (and if postponed School does not re-schedule Field Trip to another date prior to June 15, 2018), Sponsor and Administrator shall have no liability to School and School must return grant money to Sponsor immediately upon demand.
  5. Conditions of Participation: If, for any reason, the Program is not capable of running as planned, including but not limited to due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify and/or suspend the Program. If the Program is so affected, the Administrator, acting in concert with Sponsor will conduct the Program and make grant monies available to Schools in the above-indicated counties in the above-indicated monetary thresholds per Field Trip Location in a manner deemed fair, equitable and in accordance with the spirit of these Official Rules as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on Kohls.com/fieldtrip. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of applications; errors, defects or omissions in the advertisement or offering of this Program; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or electronic application (or other Program materials, as applicable) to be received on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, including any injury or damage to School’s or any person’s computer related to, or resulting from, participation in or downloading or uploading any materials for this Program. Sponsor’s/Administrator’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.

    Application Contact on behalf of School further agrees not to knowingly damage or cause interruption of the Program and/or prevent others from participating in the Program. Submission of an application is acknowledgement of, and agreement by Application Contact on behalf of School to be bound by these Official Rules of this Program. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM VIOLATES CRIMINAL OR CIVIL LAWS. THE PRECEDING INCLUDES BUT IS NOT LIMITED TO ANY ATTEMPT TO DEFRAUD SPONSOR AND/OR ADMINISTRATOR WITH RESPECT TO THE SUBMISSION OF AN APPLICATION, THE USE OF GRANT MONIES, COMPLETION OF FIELD TRIPS OR OTHERWISE. IF SUCH AN ATTEMPT IS MADE, SPONSOR/ADMINISTRATOR MAY TAKE ANY AND ALL ACTIONS DEEMED APPROPRIATE BY SPONSOR/ADMINISTRATOR AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

  6. Disputes: To the fullest extent permitted by law, Application Contact on behalf of School agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Program or the award (or non-award) of grant monies shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Wisconsin or an appropriate Wisconsin State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Program, but in no event attorneys' fees; and (3) under no circumstances will School (or anyone associated with School, including but not limited to Application Contact) be permitted to obtain awards for, and Application Contact on behalf of School hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the School, on the one hand, and Sponsor, on the other hand, in connection with the Program shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.
